Abstract

Review

This paper presents a compelling and timely analysis of the "CASO LÔ," meticulously examining the tragic death of Clodimar Pedrosa Lô under torture by military police in 1967. The research goes beyond mere historical recounting by undertaking a rigorous reconstitution of the facts, which is crucial for such an emblematic case from a period of intense state repression. Its principal contribution lies in the application of current Brazilian legislation—specifically regarding crimes of abuse of authority, torture, and qualified homicide—to assess the criminal responsibility of the state agents involved. This approach offers a powerful re-evaluation of historical injustices through a contemporary legal lens, making the paper highly relevant to discussions on justice and accountability. A significant strength of the study is its critical engagement with the broader implications of the Lô case. The authors adeptly connect the historical incident to persistent issues of institutional violence and structural racism in Brazil, arguing that the impunity and selective justice afforded to state agents continue to reflect deep-seated societal problems. This interdisciplinary approach, merging historical investigation with legal analysis and sociological critique, provides a rich framework for understanding how past transgressions cast long shadows on contemporary challenges to human rights. The paper effectively positions the case not just as a historical tragedy but as a critical reflection on the enduring limitations of justice in confronting grave human rights violations. Given the depth of its analysis, the paper serves as a vital contribution to both historical memory and legal scholarship concerning state accountability. While the abstract clearly outlines the application of current law to past events, further explicit discussion within the paper regarding the methodological and legal challenges of such an undertaking—for instance, navigating issues of amnesty laws, evolving legal definitions, or the practicalities of evidence from decades past—could further enrich its impact. Nevertheless, this work is invaluable for its sharp focus on a foundational case of state violence and its unwavering commitment to fostering a critical dialogue about justice, impunity, and the imperative to confront structural inequalities in Brazil. It is a highly recommended read for anyone interested in human rights, transitional justice, and the socio-legal history of Brazil.
