Indonesia adalah negara yang menganut prinsip negara hukum, di mana segala aspek kehidupan masyarakat diatur oleh hukum. Salah satu aspek yang sering menjadi perhatian dalam sistem hukum adalah kejahatan, di antara kejahatan yang banyak terjadi di masyarakat adalah tindak pidana pencurian dengan kekerasan disebut juga begal. Dalam KUHP termaktum pada pasal 365 bahwa begal sering menimbulkan kerugian fisik, mental, dan materi bagi korban. Penelitian ini adalah penelitian hukum yuridis normatif yang dilakukan berdasarkan aturan hukum yang berlaku dalam peraturan perundang-undangan yang berhubungan dengan penelitian ini, yang bersifat deskriptif analisis, dengan pendekatan perundang-undangan (statute approach), dan pendekatan konseptual (conceptual approach), sedangkan sumber data yang dipakai adalah sumber data sekunder, teknik pengumpulan data melalui studi kepustakaan, serta dianalisis dengan analisis kualitatif. Berdasarkan hasil penelitian ditemukan bahwa perlu adanya implementasi regulasi hukum dalam menangani beberapa kasus, seperti pendekatan restoratif yang lebih bermanfaat bagi korban. Korban dapat terlibat dalam proses mediasi yang mempertemukan pelaku dengan korban. Oleh karena itu, diperlukan pendekatan alternatif yang lebih berfokus pada keadilan restoratif, salah satunya melalui mediasi non penal.

The emphasis on empowering victims and promoting their involvement in the resolution process represents a significant step towards a more humane and effective justice system. While the abstract provides a compelling case for non-penal mediation, a more detailed elaboration on the practical implementation and potential challenges would enhance the paper's impact. Future iterations or subsequent research could delve deeper into the specific legal frameworks or regulatory changes required to institutionalize non-penal mediation for violent crimes in Indonesia. Considerations regarding the scope of such mediation (e.g., for different levels of violence), the training and accreditation of mediators, and mechanisms to ensure victim safety and voluntary participation would also be valuable. Despite these potential areas for further exploration, this paper provides a strong conceptual foundation for integrating restorative justice principles into the Indonesian criminal justice system, particularly for victims of violent theft.
