Abstract

Penelitian ini bertujuan untuk.mengkaji bagaimana pengaturan restorative justice dalam peraturan perundang-undangan pidana di Indonesia saat ini. Penelitian dilakukan secara normative dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa Indonesia telah mengatur mengenai restorative justice baik sebagai pendekatan penyelesaian tindak pidana ataupun sebagai proses. Pengaturannya dapat ditemukan dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana, kemudian diatur dalam Peraturan Kapolri Nomor 8 Tahun 2021, Perja Nomor 15 Tahun 2020, Perma Nomor 4 tahun 2014 dan Nomor 1 Tahun 2024. Meskipun demikian perlu dilakukan harmonisasi terkait syarat matriil dan formiil dalam berbagai regulasi tersebut agar tercipta harmonisasi peraturan perundang-undangan secara sistematis.
