Abstract

Penelitian ini bertujuan untuk mengetahui dan memahami bagaimana seorang penyidik dapat mengajukan tersangka penggelapan yang sedang mengalami amnesia ke hadapan pengadilan serta memahami kebijakan undang-undang dalam isu perlindungan hukum dari berbagai aspek perlindungan hukum yang relevan terhadap tersangka yang mengalami amnesia. Penelitian ini menggunakan Metode penelitian hukum Empiris. Berdasarkan hasil penelitian bahwa tersangka akan tetap dapat diajukan menjadi terdakwa oleh penyidik ke hadapan pengadilan, meskipun keadaan mental dari tersangka sedang terganggu (Amnesia) sehingga dibutuhkannya suatu bentuk perlindungan hukum terhadap tersangka yang sudah tercantum dalam KUHAP berupa, untuk diberitahu dengan jelas tentang tuduhan yang disangkakan, hak atas pendampingan hukum, hak untuk mendapatkan bantuan juru bahasa, dan hak untuk mempersiapkan pembelaan.
