Abstract

Review

The article, "Situaciones de privilegio frente a la regla ignorantia iuris nocet (ignorantia iuris non excusat)," clearly outlines its intent to explore a cornerstone of legal philosophy: the principle that ignorance of the law does not excuse its non-compliance. The abstract effectively situates this rule as a timeless and unquestionable tenet, whose application spans from ancient Roman law to modern jurisprudence. The core contribution of this work lies in its ambitious examination of specific historical exceptions to this universal principle, focusing on categories of individuals who, at various points, enjoyed a privileged exemption. The study promises a detailed investigation into the origin and evolution of these particular exceptions, which historically included minors, *rustici* (rural inhabitants), women, and soldiers. By explicitly labeling these as "true privileges," the article signals a critical historical analysis of how certain societal roles, statuses, or perceived vulnerabilities led to differentiated legal treatment regarding the *ignorantia iuris* rule. The proposed historical scope, tracing these developments from antiquity to the present, suggests a comprehensive and insightful exploration of how legal principles adapt, and how concepts of equality and responsibility have evolved within legal systems. This research appears poised to offer valuable insights into the sociological and jurisprudential underpinnings of legal equality, particularly concerning legal knowledge and accountability. By dissecting the genesis and eventual disappearance of these privileges in modern law, the article can illuminate the ongoing trajectory towards the universal application of legal principles, while simultaneously providing a critical lens through which to understand historical disparities. This work promises to be a significant contribution to legal history, offering a deeper understanding of how fundamental legal maxims have been shaped and challenged across different eras and societies.
