Simplifikasi perizinan dalam sistem pemerintahan berbasis elektronik di lingkungan pemerintah . Kaji urgensi simplifikasi perizinan & penyederhanaan regulasi dalam SPBE untuk tingkatkan kualitas pelayanan publik, efisiensi birokrasi, serta kepastian hukum di pemerintahan.

Abstract

Transformasi digital dalam penyelenggaraan pemerintahan telah mendorong penerapan Sistem Pemerintahan Berbasis Elektronik (SPBE) sebagai instrumen untuk meningkatkan kualitas pelayanan publik, efisiensi birokrasi, transparansi, dan akuntabilitas pemerintahan. Namun, implementasi SPBE di Indonesia masih menghadapi berbagai kendala, terutama akibat banyaknya regulasi sektoral yang menimbulkan disharmonisasi, tumpang tindih pengaturan, dan kompleksitas birokrasi. Penelitian ini bertujuan menganalisis substansi hukum penyelenggaraan SPBE serta mengkaji urgensi penyederhanaan regulasi dalam mendukung implementasi SPBE di lingkungan Pemerintah Kota Bitung, Provinsi Sulawesi Utara. Penelitian menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual, yang didukung melalui studi kepustakaan serta wawancara dengan narasumber terkait. Hasil penelitian menunjukkan bahwa pengaturan SPBE yang berlaku saat ini belum sepenuhnya memberikan kepastian hukum karena masih tersebar dalam berbagai regulasi yang belum terintegrasi secara harmonis. Oleh karena itu, penyederhanaan regulasi melalui harmonisasi pengaturan, pemetaan regulasi, penguatan koordinasi antarlembaga, peningkatan kapasitas kelembagaan, evaluasi berkala, serta pelibatan pemangku kepentingan dalam pembentukan regulasi menjadi langkah yang diperlukan untuk memperkuat kepastian hukum, meningkatkan efektivitas implementasi SPBE, dan mewujudkan tata kelola pemerintahan yang baik.
