Abstract

Questo contributo è dedicato ai diversi modi in cui il giurista si relaziona col passato, e quindi al significato che, nel campo della teoria e storia giuridica, assumono memoria (in particolare memoria culturale), identità e tradizione. Una specifica attenzione è rivolta al rapporto fra memoria e oblio, fra tradizione e analisi storiografica, fra selezione del passato e costruzione dell'identità. This paper focuses on the different ways in which the jurist relates to the past, and therefore on the meaning that memory (particularly cultural memory), identity and tradition assume in the field of legal science. Specific attention is dedicated to the relationship between memory and oblivion, between tradition and historiographical analysis, between selection of the past and construction of identity.
