Introduction

Keberlakuan aturan pemaksaan perkawinan berdasarkan uu no. 12 tahun 2022 tentang tindak pidana kekerasan seksual dalam penegakkan awig – awig di kabupaten lombok utara. Menganalisis penerapan UU No. 12 Tahun 2022 tentang kekerasan seksual pada pemaksaan perkawinan dalam penegakan awig-awig di Lombok Utara, termasuk revitalisasi sanksi adat.

Abstract

ABSTRAK Penelitian ini menganalisis mengenai ketentuan tindak pidana pemaksaan perkawinan berdasarkan pasal 10 UU Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual dapat diterapkan dalam penegakkan awig – awig di Kabupaten Lombok Utara. Metode yang digunakan penelitian normatif dengan pengumpulan data berupa studi Pustaka serta beberapa pendekatan Perundang – Undangan dan Konseptual. Sehingga penelitian ini dapat dilihat bahwa ketentuan tentang pemaksaan perkawinan tersebut dapat berlaku dalam penegakkan awig-awig kawin maghrib di KLU melalui teori sifat melawan hukum materiil dalam fungsi negatif, tetapi diperlukan revitalisasi terhadap sanksi adat tersebut berupa denda sejumlah uang bolong. Kata Kunci: Pemaksaan Perkawinan, Awig-Awig, Lombok Utara
