Indonesia sebagai negara dengan jumlah pengiriman pekerja migran yang tinggi ikut meratifikasi International Convention on the Protection of the Right of All Migrant Workers and Members of their Families yang disahkan oleh Perserikatan Bangsa Bangsa tahun 1990. Hal ini isa dilihat dari disahkannya Undang-Undang Nomor 6 Tahun 2012. Konvensi yang mengatur tentang perlindungan bagi pekerja migran dan juga keluarganya ini sangat penting bagi Indonesia untuk menjamin hak-hak setiap warganya yang sedang bekerja di luar negeri. Penelitian ini menggunakan penelitian hukum normatif. Penelitian ini menerapkan analisis deskriptif dengan data primer dan sekunder yang sudah diperoleh, yang kemudian data tersebut dianalisis secara kualitatif. Hasil dari penelitian ini menunjukkan adanya harmonisasi dari konvensi migran 1990 ke dalam Undang-udang Indonesia. Ini terbukti dengan adanya nilai-nilai dalam UU yang diadopsi dari konvensi migran 1990 baik dalam UU Pengesahan No 6 tahun 2012 maupun UU 18 tahun 17 tentang perlindungan pekerja migran Indonesia, yang mulai dari lingkup dari pekerja migran, hak-hak yang harus didapat oleh pekerja migran, sampai pelayanan untuk konsultasi bagi pekerja migran.
This paper addresses a highly pertinent issue concerning Indonesia's commitment to protecting its substantial migrant worker population through the integration of the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families (1990 UN Convention) into its national legal system. The research specifically examines the ratification of this convention, evidenced by Law No. 6 of 2012, and subsequent domestic legislation, particularly Law No. 18 of 2017, which aims to safeguard migrant workers. The core finding suggests a significant degree of harmonization between the principles of the 1990 UN Convention and Indonesian national laws, covering aspects from the scope of migrant workers to their fundamental rights and access to consultation services. This topic is of critical importance given Indonesia's status as a major labor-sending country. Methodologically, the study employs a normative legal research approach, utilizing descriptive and qualitative analysis of both primary and secondary data. This framework is appropriate for assessing the textual integration of international legal instruments into national law, effectively identifying the legislative alignment between the Convention and national statutes. While the abstract clearly states the findings of harmonization, it could benefit from more detailed insights into the specific criteria or analytical framework used to determine this harmonization beyond a general comparison of values. For instance, elaborating on the depth of "descriptive analysis" and the nature of "primary data" would enhance the transparency and robustness of the methodological explanation. The findings of this paper contribute valuable insights into the legal efforts undertaken by Indonesia to uphold the rights of its migrant workers in accordance with international standards. The established harmonization provides a strong legal foundation for protection, indicating a positive step towards fulfilling international obligations. However, the abstract, by focusing solely on legislative integration, leaves room for further inquiry into the practical efficacy of these harmonized laws. Future research could extend beyond legislative text to investigate the actual implementation challenges, enforcement mechanisms, and the tangible impact of these laws on the ground for migrant workers and their families, thereby providing a more comprehensive understanding of migrant worker protection in Indonesia.
