dc.title: Instytucja nocnego burmistrza. Analiza prawna na tle uchwały Rady Miasta Krakowa dc.contributor.author: Wyszyński, Filip dc.description.abstract: Celem niniejszego opracowania jest analiza instytucji nocnego burmistrza. Instytucja ta została wprowadzona w kilkudziesięciu miastach rozlokowanych na całym świecie. Kraków był pierwszym miastem w Polsce, gdzie w 2019 r. próbowano wprowadzić instytucję nocnego burmistrza. Uchwała była jednak dotknięta nieważnością z punktu widzenia formalnego. W opracowaniu rozważono pozycję prawną nocnego burmistrza w ujęciu prawnoporównawczym.; The purpose of this study is to analyze the institution of the night mayor. This institution was introduced in several dozens of cities around the world. Kraków was the first city in Poland where an attempt to implement the institution of the night mayor was made, and the attempt took place in 2019. However, the resolution was invalid from a formal point of view. The study considers the legal position of the night mayor from a comparative legal perspective.
The submitted work, "Instytucja nocnego burmistrza. Analiza prawna na tle uchwały Rady Miasta Krakowa," undertakes a pertinent legal analysis of the increasingly recognized institution of the night mayor. This globally adopted concept, designed to manage urban nightlife, gains particular relevance in the Polish context through the lens of Kraków's 2019 attempt to establish such a position. The abstract clearly outlines the study's objective to scrutinize the legal standing of the night mayor, specifically addressing the formal invalidity that plagued Kraków's initial resolution. The author signals a commitment to a comparative legal perspective, suggesting a broad-based examination of this innovative municipal role. The chosen topic is commendably timely and significant, filling a gap in Polish legal literature regarding municipal governance and urban policy. By focusing on the *legal* dimensions, the paper promises to move beyond mere descriptive accounts to critically assess the statutory and regulatory challenges associated with integrating a night mayor into existing municipal structures. The specific examination of Kraków's failed attempt offers valuable insights into the practical and formal hurdles faced by local authorities. Furthermore, the inclusion of a comparative legal analysis is a notable strength, as it allows for an understanding of diverse approaches and potential best practices from cities worldwide, enriching the discussion and providing a broader context for potential future implementations in Poland. While the abstract provides a strong foundation, a comprehensive analysis would benefit from a deeper dive into several areas. It would be valuable to understand the precise nature of the "formal invalidity" of the Kraków resolution – what specific legal provisions or procedural requirements were not met, and why? Additionally, the comparative legal analysis should ideally detail the different models of legal integration for night mayors observed globally, distinguishing between roles with strong statutory backing versus those operating in advisory or informal capacities. Exploring the potential legal frameworks or legislative adjustments that might enable a successful implementation of the night mayor institution in Poland, moving beyond merely identifying challenges, would further enhance the study's practical utility and policy relevance.
