Abstract

El 23 de octubre de 2024 fue aprobada la Directiva (UE) 2024/2853 sobre responsabilidad por productos defectuosos, intentando responder así a algunos de los daños derivados de las tecnologías digitales emergentes. El presente artículo analiza la adaptación de uno de los conceptos centrales de ese régimen, como es el carácter defectuoso del producto, con el objetivo de identificar sus aciertos y las dificultades que pueden surgir en la práctica. En un primer apartado se estudiarán tanto la renovada definición de defecto, como el estándar consistente en la seguridad que el gran público tiene derecho a esperar. A continuación, el segundo apartado está dedicado a la evaluación del carácter defectuoso del producto, que deberá hacerse de manera casuística y teniendo en cuenta todas las circunstancias concurrentes. Algunas han sido contempladas expresamente en la Directiva, y el transcurso del tiempo no tendrá el mismo efecto sobre todas ellas. Por ese motivo se subraya la importancia de ser conscientes del «prejuicio de retrospectiva» y del «sesgo de resultado», con el fin de mantener el equilibrio de intereses pretendido por el legislador, y proteger suficientemente a las víctimas.
