Abstract

Review

This paper, "Doenças psicossomáticas e teletrabalho," tackles a critically timely and relevant subject stemming from the profound shifts in the contemporary world of work. Situated within the context of neoliberalism and technological advancements, the abstract effectively underscores the widespread expansion of telework, a phenomenon greatly accelerated by the recent pandemic. The core objective of the article is to critically examine the intricate challenges associated with recognizing the causal nexus between psychosomatic illnesses and health disorders that emerge within the telework organizational model, employing the evocative concept of "corpo-território" (body-territory) as its analytical framework. To address its central inquiry, the study outlines a qualitative methodological approach, focusing on the analysis of jurisprudence from the Regional Labor Court of the 3rd Region (TRT-3), meticulously compared with decisions from the Superior Labor Court (TST). This choice of methodology is highly appropriate for dissecting the practical and legal complexities surrounding the recognition of causality for psychosomatic conditions experienced by teleworkers. The abstract further assures a comprehensive exploration through a critical perspective and a thorough doctrinal examination, ensuring a robust and well-informed discussion of the psychosocial risks intrinsic to the remote work paradigm and their impact on the worker's personal and professional "territory." The paper's timeliness, its interdisciplinary scope—melding legal, sociological, and health perspectives—and its critical stance are notable strengths, promising a valuable contribution to the evolving discourse on labor protection in the digital era. By asserting that the principle of labor protection must have an expansive connotation, transcending the confines of a physical workspace, the research strongly advocates for a broader understanding of worker rights and well-being. This study is poised to significantly inform legal frameworks, judicial decision-making, and organizational policies, ultimately fostering a more protective and equitable environment for teleworkers navigating the unique psychosocial demands of their increasingly distributed work landscape.
