Introduction

Analisis penerapan pasal 70 undang-undang nomor 11 tahun 2012 sebagai judicial pardon terhadap anak yang melakukan pencurian dengan pemberatan . Menganalisis konsep dan penerapan judicial pardon Pasal 70 UU SPPA terhadap anak pelaku pencurian dengan pemberatan, serta pertimbangan hakim dalam putusan pemaafan.

Abstract

Penelitian ini bertujuan menganalisis konsep judicial pardon dalam Pasal 70 UU SPPA dan pertimbangan hakim perkara nomor:2/Pid.Sus-Anak/2021/PN.Rgt yang menerapkan judicial pardon terhadap anak yang berkonflik dengan hukum. Penelitian ini menggunakan penelitian hukum normatif. Hasil penelitian ini, Pasal 70 UU SPPA perwujudan dari konsep judicial pardon, terbangun atas unsur-unsur Pasal 70 UU SPPA, sebagai klep/katup pengaman bagi hakim dalam penyelesaian perkara anak. Hakim menerapkan judicial pardon, karena kasus tersebut memenuhi syarat, yaitu ringannya perbuatan, keadaan pribadi anak, keadaan pada waktu dilakukan perbuatan, yang terjadi kemudian, dan mempertimbangkan keadilan dan kemanusiaan. Diperlukan harmonisasi antara hukum pidana materill dan formil mengenai putusan pemaafan.   Kata Kunci: pasal 70 UU SPPA, judicial pardon.
