E-voting berpotensi tingkatkan partisipasi, perlu diatur dalam UU No. 7/2017.
The aim of this research is to determine and analyze the position of e-voting in current election laws and regulations and the reformulation of the voting system in elections in Indonesia. E-voting can be a solution to increase voter participation, especially among voters who live abroad or in remote areas. With the existence of an electronic voting system, voters can more easily cast their votes without having to come to a physical polling place. The type of legal research used is normative. Data analysis was carried out descriptively and qualitatively. The position of e-voting in election laws and regulations is currently not regulated. This has resulted in the absence of e-voting in voting in the election system in Indonesia. The reformulation that can be carried out is by including a new article in Law Number 7 of 2017 concerning General Elections which specifically regulates e-voting in voting in future elections. Which is then accompanied by General Election Commission Regulations regarding the e-voting system in voting in elections in Indonesia.
This research paper, "Reformulasi Sistem Pemungutan Suara Dalam Pemilihan Umum di Indonesia," addresses a highly relevant and timely topic concerning the modernization of electoral processes in Indonesia. The authors clearly delineate their objectives: to analyze the current legal status of e-voting within existing election laws and regulations, and subsequently to propose a reformulation of the national voting system. The stated motivation, linking e-voting to increased voter participation—especially among populations abroad or in remote areas—highlights the practical significance of this study in enhancing democratic accessibility and efficiency within the Indonesian context. Employing a normative legal research methodology, complemented by descriptive qualitative data analysis, the study appropriately focuses on the examination and interpretation of legal frameworks. The core finding reveals a critical lacuna: e-voting is currently not regulated within Indonesia's election laws, which consequently prevents its implementation. To address this legislative void, the research proposes a concrete reformulation strategy. This involves the insertion of a new, dedicated article into Law Number 7 of 2017 concerning General Elections, specifically governing e-voting, which would then be further elaborated and supported by detailed implementing regulations issued by the General Election Commission (KPU). The research makes a valuable and actionable contribution by precisely identifying a significant legal barrier to the adoption of e-voting in Indonesia and offering a direct roadmap for legislative reform. Its strength lies in its clarity in diagnosing the problem and proposing a specific, two-tiered legal solution. While the abstract effectively outlines the "what" and "how" of the proposed legislative changes, the full paper would ideally expand upon the deeper practical and technical considerations—such as security, privacy, accessibility, and public trust—that are paramount for the successful design and implementation of e-voting systems within the framework of the proposed new article and KPU regulations. Nevertheless, this study provides a crucial foundational analysis for policymakers and legal scholars seeking to advance and modernize Indonesia's electoral landscape.
