Abstract

Penelitian ini bertujuan untuk.mengkaji bagaimana perlindungan hukum atas data pribadi pengguna siber terhadap kejahatan siber yang kini massif terjadi sebagai dampak dari perkembangan teknologi. Indonesia telah mengesahkan Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi. Penelitian dilakukan secara normative dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa Indonesia telah mengatur mengenai perlindungan terhadap data pribadi pengguna terhadap kejahatan siber dan regulasi tersebut juga mengatur ancaman pidana terhadap pelaku. Pelaku adalah orang perseorangan atau korporasi. Sanksi pidana yang dikenakan terhadap pelaku cukup berat karena dirumuskan secara komulatif alternatif dan disertai dengan pidana tambahan. Ancaman sanksi juga diatur dengan menerapkan sanksi maksimum khusus.

Nevertheless, the paper successfully demonstrates that Indonesia has a robust legal architecture in place to combat cyber threats to personal data, offering a foundational understanding for policymakers, legal practitioners, and the public alike.
