This paper tackles a highly pertinent and sensitive area of comparative criminal law by examining the implementation of the death penalty in Indonesia and South Korea. The stated objectives are clear: to identify the types of crimes punishable by death and to compare the methods of its execution in both jurisdictions. Utilizing a normative legal research methodology, the study sets out to provide a foundational understanding of these practices. Given the global discourse surrounding capital punishment and human rights, a comparative analysis between two distinct legal systems in Asia offers valuable insights into the differing approaches and justifications for this ultimate sanction. The abstract effectively summarizes the core findings, establishing that capital offenses in both nations are stipulated within their respective Criminal Codes and various special laws. It then proceeds to highlight the procedural divergence: Indonesia employs execution by shooting, as governed by Law Number 2/PNPS/1964, while South Korea utilizes hanging, according to its Criminal Code. These findings provide a clear, albeit concise, factual basis for understanding the legal frameworks and operational methods of the death penalty in each country, setting the stage for a more detailed discussion within the full paper. While the abstract provides a solid descriptive overview, a more comprehensive comparative analysis would significantly benefit from deeper exploration of the nuances surrounding "implementation." Notably, the abstract does not mention South Korea's de facto moratorium on executions since 1997, which is a critical aspect of its current "implementation" status. Future iterations or the full paper would be strengthened by addressing not just the methods, but also the frequency, legal challenges, public opinion, and the broader socio-political context influencing the application (or non-application) of the death penalty in both countries. Exploring the philosophical underpinnings and international human rights obligations would also enrich the comparative value beyond mere procedural differences, offering a more robust and nuanced understanding of capital punishment in these nations.
