Abstract

Indonesia merupakan negara yang kaya akan sumber daya alamnya termasuk sumber daya mineral seperti Timah, Batubara dan Nikel. di mana saat ini nikel menjadi salah satu sumber daya mineral yang banyak dibutuhkan sebagai bahan untuk pembuatan battery baik untuk kendaraan Listrik maupun keperluan lainnya. Dalam aturan yang ada saat ini izin penambangan nikel dikeluarkan oleh Pemerintah Pusat, di mana sebelumnya izin penambangan skala tertentu dapat dikeluarkan oleh Bupati. Namun walaupun Pemerintah Daerah (PEMDA) tidak mengeluarkan izin, tetapi PEMDA mempunyai tugas untuk mengawasi kegiatan penambangan nikel termasuk menindaklanjuti bila ada laporan dari Masyarakat terkait kerusakan lingkungan yang merugikan Masyarakat. Masalah yang akan dikaji adalah bagaimana peranan PEMDA terkait penambangan nikel. Masalah izin penambangan akan terkait dengan kewajiban pengusaha untuk menaati aturan yang ada termasuk aturan tentang perlindungan lingkungan. Beberapa aturan yang ada telah mengatur tentang peranan PEMDA baik terkait masalah minerba maupun masalah perlindungan lingkungan, namun pelaksanaannya masih belum maksimal karena ternyata beberapa pengusaha tidak melaksanakan kewajibannya.

Understanding these dynamics is essential for ensuring sustainable resource management, accountability of mining companies, and the protection of local communities and ecosystems. To further strengthen this important work, the abstract would benefit from a clearer indication of the specific legal frameworks PEMDA is expected to operate within (e.g., particular laws or government regulations). While the problem of non-compliance is noted, the methodology for assessing PEMDA's role and the reasons behind the "not maximal" execution of entrepreneurial obligations are not articulated. Detailing the research approach, such as case studies, legal analysis, or interviews with stakeholders, would enhance the study's scientific rigor. Additionally, exploring the specific challenges PEMDA faces in exercising its supervisory functions without direct licensing authority, and potential mechanisms for improved inter-governmental coordination, could provide deeper insights and practical recommendations.
