Abstract

Fiqh al-h}adis\ kurang begitu diperhatikan peneliti modern. Ia belum banyak dibahas dalam bentuk penelitian dan karya tersendiri berupa buku. Padahal ia merupakan metodologi istinbat yang aplikatif dari khazanah keilmuan ulama klasik. Apalagi fakta menunjukkan bahwa kebutuhan umat untuk memahami makna dan kandungan hadis semakin tinggi; mengingat peristiwa hukum yang memerlukan dalil terus bertambah dan pelik. Tuntutan agar hadis selalu berdialog dengan konteks semakin mendesak. Fiqh al-h}adi>s\ mesti hadir menawarkan alternatif untuk mengurai gejala tersebut dengan menunjukkan sisinya yang s}a>lih}un likulli zama>n wa maka>n. Secara metodologi kerja ilmiah fiqh al-h}adi>s\ ini lebih mendalam daripada syarah hadis. Jika syarah hadis hanya sekadar membantu pembaca memahami redaksi hadis lebih lanjut maka Fiqh al-h}adi>s\ lebih dari itu, yakni mengeluarkan hikmah, hukum dan kedudukan hadis dilihat dari berbagai sisi, baik sanad, matan atau yang lainnya bahkan kontekstualisasinya di zaman sekarang. Melalui metode kualitatif, penelitian ini mencoba melacak eksistensi Fiqh al-h}adi>s\ dari kitab-kitab syarah hadis juga dari Riwayat-riwayat yang tepercaya. Hasil kajian ini berkesimpulan bahwa dalam konteks Fiqhal-h}adi>s\ memiliki geneologi yang panjang dan dapat dilacak dengan baik.
