PELAKSANAAN ASAS STELSEL AKTIF TERHDAP PEROLEHAN AKTA KELAHIRANMENURUT UNDANG-UNDANG NOMOR 24 TAHUN 2013 TENTANG PERUBAHAN ATAS UNDANG-UNDANG NOMOR 23 TAHUN 2006 TENTANG ADMINISTRASI KEPENDUDUKAN (Studi di Kecamatan Utan Kabupaten Sumbawa)

Introduction

Pelaksanaan asas stelsel aktif terhdap perolehan akta kelahiranmenurut undang-undang nomor 24 tahun 2013 tentang perubahan atas undang-undang nomor 23 tahun 2006 tentang administrasi kependudukan (studi di kecamatan utan kabupaten sumbawa). Pahami pelaksanaan asas stelsel aktif perolehan akta kelahiran di Kecamatan Utan, Sumbawa, menurut UU No. 24/2013 tentang Administrasi Kependudukan. Analisis faktor penghambat dan pendukung.

Abstract

Penelitian ini bertujuan untuk mengetahui dan memahami pelaksanaan asas stelsel aktif terhadap perolehan akta kelahiran serta faktor penghambat dan pendukung menurut Undang-Undang Nomor 24 Tahun 2013 Tentang Perubahan Atas Undang-Undang Nomor 23 Tahun 2006 Administrasi Kependudukan di Kecamatan Utan Kabupaten Sumbawa penelitian ini menggunakan metode pendekatan undang-undang dan pendekatan sosiologis. Hasil penelitian menunjukkan bahwa pelaksanaan asas stelsel aktif melalui Program Silamo dan Program Jango Desa terhadap perolehan akta kelahiran di Kecamatan Utan berjalan cukup baik namum belum efektif. Faktor pendukung ialah faktor hukum dan partisipasi masyarakat. Adapun faktor prnghambat ialah faktor pelaksana hukum dan sarana atau fasilitas.

This paper undertakes an investigation into the implementation of the "active stelsel principle" concerning the acquisition of birth certificates in Utan District, Sumbawa Regency, Indonesia. Drawing its legal framework from Law No. 24 of 2013, which amended Law No. 23 of 2006 on Population Administration, the study's primary objective is to understand the operational execution of this principle, along with identifying the contributing supporting and hindering factors. The methodology adopted is a commendable combination of legal and sociological approaches, providing a comprehensive lens through which to examine this crucial aspect of civil administration. The research's findings indicate that the active stelsel principle, realized through local initiatives such as Program Silamo and Program Jango Desa, is functioning "quite well" in facilitating birth certificate acquisition, although it has not yet achieved full effectiveness. Supporting factors for this implementation are identified as the existing legal framework and robust community participation, underscoring the importance of both top-down regulatory backing and grassroots engagement. Conversely, the study highlights significant obstacles, primarily stemming from challenges related to law enforcement officials ("pelaksana hukum") and inadequate facilities or infrastructure, suggesting a gap in human resource capacity and material support. Overall, this study makes a pertinent contribution to the understanding of civil registration dynamics at the local government level in Indonesia. By clearly delineating specific programs, as well as the dual nature of supporting and hindering factors, the research provides valuable actionable insights for policymakers and administrative bodies. To transition from "quite good" to truly effective, future strategies must focus on addressing the identified weaknesses in implementation, particularly enhancing the capacity and resources of personnel involved and upgrading the necessary facilities, thereby strengthening the fundamental rights of citizens through improved population administration.
