This paper addresses a highly pertinent and complex issue within digital copyright law: the liability of internet operators for intellectual property infringements arising from the use of framing techniques. The abstract effectively highlights the core problem, noting how framing allows the integration of protected content from one website onto another, potentially creating an unauthorized public communication. The authors correctly identify the increased risk posed by "inline framing," which seamlessly embeds external resources, often without users realizing the content originates elsewhere. This distinction is crucial as it underpins many of the legal ambiguities and challenges faced by both rights holders and online intermediaries in the evolving digital landscape. A significant strength of this work, as indicated by the abstract, lies in its specific focus on the evolution of jurisprudence from the Court of Justice of the European Union (CJEU) over the past decade. This targeted approach is highly valuable, as CJEU decisions play a pivotal role in shaping copyright law across the European Union, making this analysis directly relevant to a wide audience of legal practitioners, academics, and internet service providers operating within or interacting with the EU legal framework. By tracing the development of the CJEU's stance, the paper promises to offer a comprehensive and timely overview of how courts have grappled with the nuances of framing and operator responsibility, thereby contributing significantly to understanding the current legal position and its trajectory. The insights derived from analyzing the CJEU's pronouncements on framing liability are critical for clarifying the boundaries of responsibility for internet operators. Such an analysis would provide much-needed guidance on due diligence requirements, potential safe harbor provisions, and the scope of what constitutes an "act of communication to the public" in the context of embedding content. Furthermore, the paper's findings are likely to inform ongoing debates surrounding platform liability, technological neutrality, and the future development of copyright directives in the digital single market. This research serves not only as a review of past legal developments but also as a foundation for understanding future policy considerations and potential legislative adjustments necessary to adapt copyright law to ever-advancing web technologies.
