Abstract

Imigrasi terhadap Visa on Arrival (VoA) di Wilayah Kantor Imigrasi Mataram Berdasarkan Undang-Undang Nomor 6 tahun 2011 tentang Keimigrasian. mengetahui faktor penghambat dan solusi dari pelaksanaan penegakkan hukum melalui Pengawasan Keimigrasian terhadap Warga Negara Asing terkait Visa on Arrival (VoA) di Wilayah Kantor Imigrasi Mataram. Penelitian ini menggunakan metode penelitian hukum empiris dengan menggunakan pendekatan sosiologis. Data dikumpulkan melalui pertanyaan singkat melalui kuesioner dan wawancara dengan pihak terkait dalam hal ini pejabat Kantor Imiigrasi Mataram. Dalam penelitian ini ditemukan bahwa mekanisme pengawasan keimigrasian telah berjalan sesuai dengan ketentuan Undang-Undang nomor 6 tahun 2011 tentang keimigrasian akan tetapi masih ada tantangan dalam hal deteksi dini dan pelanggaran seperti overstay. Faktor utama yang menghambat efektivitas pengawasan VoA di Kantor Imigrasi Mataram meliputi keterbatasan personel keimigrasian, kurang optimalnya penggunaan teknologi informasi dalam sistem pengawasan, serta masih adanya celah dalam pengawasan di beberapa titik masuk wilayah yang menjadi pintu masuk wisatawan asing. Pemerintah harus melakukan revisi dan penegasan kembali terkait batasan aktivitas serta larangan bagi wisatawan asing pemegang VoA. Kantor Imigrasi Mataram perlu melakukan peningkatan kualitas Sumber Daya Manusia (SDM) khususnya anggota TIMPORA melalui pelatihan khusus terkait profiling WNA. Selain itu, Pejabat Kantor Imigrasi Mataram harus membuat program sosialisasi untuk menjelaskan manfaat dari APOA dalam melakukan pengawasan terhadap orang asing serta memberikan panduan praktis mengenai penggunaan aplikasi.

The findings reveal that while the existing immigration supervision mechanism largely adheres to the provisions of Law Number 6 of 2011, it is significantly hampered by ongoing challenges related to early detection of potential issues and the prevalence of violations such as overstay. The research meticulously identifies key inhibiting factors, including the evident limitations in immigration personnel, the suboptimal utilization of information technology within the surveillance system, and the persistent presence of loopholes in supervision at various entry points for foreign tourists. The study culminates in a set of practical and policy-oriented recommendations that hold significant implications for strengthening immigration control. It urges the government to review and re-emphasize the permissible activities and prohibitions for foreign tourists holding VoA. Furthermore, specific to the Mataram Immigration Office, the paper advocates for enhancing the quality of human resources, particularly through specialized profiling training for members of TIMPORA (Team for Supervision of Foreigners). Crucially, it highlights the need for immigration officials to actively promote and provide practical guidance on the use of the APOA application, an important tool for supervising foreigners. Overall, this research provides valuable insights into the operational realities of VoA supervision and offers a clear roadmap for improving its effectiveness, thereby contributing meaningfully to both academic understanding and policy development in Indonesian immigration law.
