In the era of globalization, it is not only increasing speed and acceleration in the economic field, as well as technology. But furthermore that this can trigger the development of social culture and patterns of people's behavior to become increasingly individual. Not to mention the existence of social media which makes people not only understand what they want, but also what they don't want such as the consumptive lifestyle of influencers and the existence of flexing behavior which creates jealousy at the grassroots level. This certainly encourages negative behavior in order to realize what people dream of becoming a reality instantly. Of course this then triggers people to commit crimes such as theft, fraud and so on. However, as is basically the rule of society, sometimes the crimes committed are not serious crimes. This can then be implemented as a settlement outside of criminal justice by using procedural diversion carried out in the field by bhabinkamtibmas which is the smallest unit currently owned by law enforcers who have scope of work in sub-districts/villages. The method used in this study is an empirical legal research method that focuses on processing qualitative primary data in the form of field findings. The data analysis method used is qualitative which is conveyed through descriptive grammar.
The article, "Upaya Restorative Justice di Tingkat Penyidikan Melalui Konstruksi Diskresi Bhabinkamtibmas Studi Polres Wonosobo," addresses a highly pertinent and contemporary issue in legal and social policy. The abstract effectively situates the research within the broader context of globalization, increasing individualism, and the impact of social media on societal behavior, linking these phenomena to the rise of minor crimes. The core problem identified – the need for alternative dispute resolution for non-serious offenses – is compelling, particularly its focus on the potential for diversion. By examining the discretionary role of Bhabinkamtibmas at the village level, the study promises to shed light on a crucial, yet often overlooked, aspect of restorative justice implementation within the Indonesian criminal justice system. The methodological approach, described as empirical legal research focusing on qualitative primary data and analyzed via "descriptive grammar," indicates an intention to explore the lived experiences and practices of Bhabinkamtibmas. While the abstract outlines the general method, a full paper would benefit from a more detailed exposition of the specific qualitative techniques employed, such as interviews, focus groups, or observations, and the criteria for data collection and participant selection. Furthermore, the concept of "descriptive grammar" as a data analysis method could be clarified to ensure it aligns with established qualitative analytical frameworks, providing a robust and rigorous interpretation of field findings related to the construction of discretion in practice. This level of detail is critical for evaluating the study's validity and reliability. Overall, this study holds significant promise for contributing to the discourse on restorative justice and the practical application of police discretion in Indonesia. Its specific focus on Bhabinkamtibmas offers a unique perspective on how informal mechanisms can be leveraged to address minor offenses, potentially alleviating pressure on formal judicial processes and fostering community-based resolutions. To maximize its impact, a comprehensive paper should elaborate on the legal and policy frameworks that permit or constrain Bhabinkamtibmas discretion, provide concrete examples of successful restorative justice interventions, and discuss the challenges and limitations faced in their implementation. Such an exploration would offer valuable insights for policymakers and practitioners seeking to enhance justice delivery at the grassroots level.
