Konstruksi pemahaman hadis tentang lesbian, gay, biseksual dantransgender (lgbt): suatu tinjauan maqashid al-syariah. Studi ini mengkaji pemahaman hadis tentang LGBT dari perspektif maqashid al-syariah. Disimpulkan Islam melarang LGBT karena perbuatan keji, bertentangan tujuan pernikahan & pemeliharaan keturunan.

Abstract

Studi ini dimotivasi oleh masih maraknya prilaku LGBT di Indonesia, dan isu LGBT ini akan selalu mearik untuk didisikusikan. Oleh karena itu, peneliti tertarik mengkaji tema ini lebih jauh. Jenis kajian ini adalah penelitian kepustakaan dengan model kajian tematik hadis yang difokuskan pada hadis tentang LGBT (atau yang berkaitan). Pendekatan analisis yang digunakan adalah analisis sosio-historis dan maqa>s}id al-syari'ah. Kesimpulan artikel ini menjelaskan bahwa berdasarkan informasi al-Qur`an dan hadis Islam sangat melarang prilaku LGBT karena merupakan perbuatan faḥisyah (keji) dan israf (berlebihan). Kemudian dalam pendekatan maqa>s}id al-syari’ah, bahwa pernikahan mempunya tujuan membangun keluarga dan memelihara keturunan (ḥifẓ an-nasl) dan ḥifẓ an-nafs (menjaga jiwa dan eksistensi manusi). Oleh karena itu, prilaku LGBT keluar dari konsep maqa>s}id al- syari’ah. Prilaku hanya memenuhi tujuan biologis dan nafsu semata tanpa mempertimbangkan hubungannya dengan aspek-aspek kehidupan yang lebih baik.
