Abstract

Penelitian ini berawal dari sebuah kitab an-Nikah yang telah banyak dilakukan analisa oleh akademisi terkait konstruk pemikiran Syekh Arsyad al-Banjari yang notabene menyebutkan bahwa pemikirannya banyak berasal dari Syafi’iyah, di samping beliau bermazhab Syafi’i, namun tidak menutup kemungkinan pengambilan hukumnya melalui kearifan lokal yang ada. Penelitian ini berbasis literatur menggunakan studi pustaka secara ekstentif, yang berusaha untuk menemukan konstruk pemikiran Syekh Muhammad Arsyad al-Banjari dalam perspektif Konstkruksi Sosial Peter L Berger, serta mengungkap adanya relevansi konsep kafa’ah Syekh Arsyad al-Banjari dalam membangun keluarga yang harmoni, sehingga adanya faktor-faktor perceraian yang di latar belakangi oleh aib, ekonomi, zina, ketaqwaan dalam agama, serta strata sosial, yang demikian hal tersebut termasuk dalam kajian kafa’ah dapat diminimalisir. Berangkat dari teori yang menyebutkan bahwa tidak adanya kafa’ah menimbulkan aib dikemudian hari. melihat maraknya perceraian yang begitu massif, menjadi perhatian yang perlu dipertimbangkan bersama, tidak terkecuali bagi pemerintah terkait, mengingat regulasi yang ada dalam perundang-undangan berkaitan dengan kafa’ah masih belum rinci dijelaskan.
