Abstract

Menurut Survey yang dilakukan oleh Lembaga Penelitian, Pendidikan dan Penerangan Ekonomi dan Sosial (LP3ES) terdapat beberapa permasalahan yang menandakan kemunduran demokrasi di Indonesia, diantaranya adalah rendahnya partisipasi politik, adanya ancaman kebebasan berpendapat, ancamana kebebasan berserikat, dan masih banyak lagi. Ditengah persoalan demokrasi Indonesia yang banyak dan rumit memerlukan suatu alternatif sehingga tujuan negara dapat tercapai. Demokrasi deliberatif dapat menjadi alternatif dalam menjadikan demokrasi Indonesia yang ideal. Metode yang digunakan dalam penelitian ini adalah hukum normatif dengan pendekatan kepustakaan (library Research) dan pendekatan perundang-undangan yang berfokus pada analisis terhadap peraturan perundang—undangan yang berkaitan dengan pokok pembahasan. Demokrasi deliberatif memberikan arti penting yang menekankan pada musyawarah dan penggalian masalah memalui dialog dimasyarakat. Upaya Mencegah kemunduran demokrasi di Indonesia dapat melalui ide Demokrasi deliberatif. Dapat ditawarkan konsep tentang skema mencegah kemunduran Demokrasi di Indonesia dapat melalui Tahapan Musyawarah lokal yang akan menghasilkan tiga hal yaitu adanya ketersediaan ruang publik yang demokratis, terjadinya dialog antar  warga, dan adanya komuniasi yang terbuka baik warga maupun pemerintah. Selanjutnya adanya ide dan gagasan baik berupa rekomendasi kebijakan atau lainnya diharapkan dapat mencipkan kebijakan yang inklusif serta legitimit. Tujuan dilakukan tahapan tersebut untuk meningkatkan kepercayaan publik dan mengembalikan kemajuan demokrasi di Indonesia.

Furthermore, a detailed discussion on the analytical link between the "normative legal research" and "statutory approach" and the *creation* of these "democratic public spaces" and "dialogue" would significantly strengthen the argument. Nonetheless, this research offers a timely and theoretically grounded perspective on revitalizing democracy in Indonesia, providing a valuable contribution to the discourse on constitutional law and democratic governance.
